Ninety-five days from today, EU AI Act Article 50 enforcement begins. For publishers distributing content to European audiences, that means AI-generated text, images, video, and audio must be labeled — visibly, in machine-readable format — or your organization is exposed to fines up to €15 million.

This is not a pilot program or a draft guidance document. The regulation is in force. What remains is the enforcement clock running down to August 2, 2026.

The Seven-Step Compliance Checklist

Compliance is not a single purchase or a policy memo. It requires seven distinct steps, each building on the last. Organizations that skip the earlier steps and jump straight to technology will discover their deployment has no documentation behind it — which is the exact scenario that fails regulatory audit.

  1. Complete a content inventory Catalog every type of AI-generated or AI-assisted content you currently publish: text articles, images, video, audio, interactive content. Include archive content as well as new production. If you do not know what you have, you cannot label it. Most publishers discover they have been publishing AI-generated material without systematic tracking since early 2024.
  2. Map your ingestion workflows Document where content enters your organization: wire services, in-house production, freelancer submissions, user-generated content, social media embeds. Each channel needs its own detection trigger point. The common failure mode is assuming one channel is AI-free because it was historically human-only.
  3. Define your labeling standard Article 50 requires disclosures that are "clear and distinguishable" and in "machine-readable format." Decide which label format you will use across content types. Document this as internal policy before deploying tooling. Labeling decisions made ad hoc, without a written standard, do not hold up under audit.
  4. Adopt C2PA provenance for original content For content you produce internally, embed C2PA Content Credentials at creation. This is the most defensible compliance path for original content — the provenance chain is cryptographically signed and verifiable. Cameras, editing software, and AI generation tools that support C2PA are the foundation.
  5. Deploy detection for third-party content C2PA works for content you control. It does not cover wire service images, user uploads, or embeds from third parties who did not sign credentials. For this content, inference-based deepfake detection (scanning for visual and audio artifacts of synthetic media) is required. This should run before publication on all incoming visual and audio content.
  6. Establish documented human review Automation detects. Humans decide. Article 50 compliance requires documented evidence that human editorial review occurred for flagged content. This means workflow integration: flagged items routed to a reviewer, review decisions logged with timestamps, escalation procedures written down.
  7. Build the audit trail Regulators will not ask "do you have a detection tool." They will ask "show me your logs from August 3, 2026." Your audit trail must capture: detection method, confidence score, reviewer name, decision, timestamp, and final label applied. This is the difference between passing an enforcement audit and explaining yourself in a penalty proceeding.

What "Adequate Labeling" Means for Each Content Type

The regulation requires labeling that is "clear and distinguishable" to users and machine-readable. What that looks like differs by content type.

Text content

AI-generated text published to inform the public on matters of public interest requires disclosure unless it has undergone "meaningful human editorial review." The standard is not whether a human glanced at it — it is whether a human substantively rewrote, verified, or reviewed the content before publication. For text, adequate labeling includes a visible disclosure line ("This article was generated with AI assistance and reviewed by our editorial team"), metadata markup in the article HTML, and retention of review records linking the disclosure to a specific reviewer and timestamp.

Images

AI-generated or AI-manipulated images require visible disclosure at the point of consumption, not buried in metadata. The European Commission's draft Code of Practice (expected June 2026) points to C2PA Content Credentials as the preferred standard. For images, this means embedding Content Credentials in the file metadata, displaying a visible label or icon (the C2PA "cr" icon has become the emerging standard), and ensuring the label is present on every platform where the image is distributed — not just the original post.

Video

Video is the highest-stakes content type under Article 50. The regulation specifically targets deepfake video — AI-generated or AI-manipulated video depicting real people. Adequate labeling for video requires a visible on-screen indicator (text overlay or persistent icon), C2PA credentials embedded in the file, and disclosure in the platform where it is posted. For video content distributed through embeds or third-party platforms, you must verify that the labeling survives the distribution format — many embeds strip metadata.

Audio

Synthetic audio — voice clones, AI-generated speech, manipulated recordings — falls under Article 50 alongside video. Labeling requirements mirror video: visible disclosure where the audio is presented to users, machine-readable metadata, and audit records. Voice clone detection is an emerging capability; several detection vendors released audio-specific models in early 2026.

Key principle
The label must survive distribution. A C2PA credential embedded in a file that gets stripped during upload to a third-party platform is not compliant labeling. Your distribution workflow must verify that disclosures are present and visible at every endpoint where EU users encounter the content.

C2PA Provenance: The Compliance Path That Scales

C2PA (Coalition for Content Provenance and Authenticity) is the open technical standard that solves the hardest compliance problem: proving content origin across an entire distribution chain. The coalition includes Google, Adobe, Microsoft, Meta, BBC, Sony, OpenAI, TikTok, and Qualcomm, which means C2PA credentials are embedded in the cameras, editing tools, and AI generation systems that most publishers already use.

The mechanics: when content is created with a C2PA-compliant tool, the tool signs a cryptographic manifest to the file. The manifest records who created it, what tools were used, whether AI was involved, and what edits were made. The signature chain is tamper-evident — any manipulation after signing breaks the verification. Platforms and downstream consumers can verify the entire provenance history in seconds.

For publishers, C2PA adoption means three things operationally. First, require C2PA-compatible cameras and software for all in-house content production — the list of compatible tools is extensive and growing. Second, verify incoming C2PA credentials on content from wire services and partners before publishing — invalid or absent credentials are an immediate flag for further review. Third, use C2PA as the machine-readable label format, so your compliance satisfies both the disclosure requirement and the machine-readability requirement in a single implementation.

C2PA does not eliminate the need for inference detection on third-party content that lacks credentials. It is complementary: C2PA covers provenance where the chain exists; inference detection covers everything else.

Penalty Breakdown

Article 50 sits within a graduated penalty structure under the EU AI Act. Understanding which tier applies to which violation matters for prioritizing your compliance roadmap.

Tier 1 — Up to €7.5 million or 1.5% of global annual turnover: Minor infractions related to incorrect or missing information provided to enforcement authorities. Least severe and typically applies to administrative failures during investigation, not to content violations themselves.

Tier 2 — Up to €15 million or 3% of global annual turnover: This is the primary Article 50 penalty tier. It applies to violations of transparency obligations — specifically, failing to disclose AI-generated content as required. This is the fine publishers face for deploying AI-generated content without adequate labeling. For a mid-size publisher with €200 million annual revenue, that is up to €6 million per violation.

Tier 3 — Up to €35 million or 7% of global annual turnover: Reserved for prohibited practices and high-risk AI system violations. Publishers are unlikely to face Tier 3 penalties unless they are also deploying prohibited AI applications — biometric categorization, subliminal manipulation, social scoring — which are outside the normal scope of content publishing.

Enforcement reality
Penalties are per incident, not per organization per year. A publisher that distributes unlabeled AI-generated content across 50 articles could face cumulative penalties calculated across each distribution event. Regulators in Germany, Spain, and Italy have already issued enforcement guidance. The "we didn't know" defense has a limited shelf life — the law has been in force since August 2024.

Your Q2 and Q3 2026 Action Timeline

The Q2/Q3 split is not arbitrary. Q2 is policy and procurement — decisions made by compliance, legal, and editorial leadership. Q3 is technical deployment and training — owned by engineering and editorial operations. These are different organizational muscles, and they cannot both run in July.

Organizations that start in July will face a simultaneous procurement, integration, testing, and training sprint in a 32-day window before the enforcement date. That is how you get a deployed-but-undocumented system that fails its first audit.

Tooling: What You Actually Need to Deploy

The compliance stack has three components. You need all three; none covers the full requirement alone.

C2PA signing infrastructure — for content you produce. Adobe Firefly, Microsoft Designer, and camera manufacturers including Canon, Leica, and Sony ship C2PA support. AI generation platforms including OpenAI's DALL-E and Stability AI have begun signing outputs. If you use these tools, C2PA credentials are likely already available in your workflow — you need to activate and verify them.

Inference-based detection API — for content you receive. This is where you integrate a detection provider into your pre-publication content management workflow. Leading providers include Reality Defender, Blackbird.AI, identifAI (EU-built, Article 50-specific), and Truepic. Each provides an API that accepts images, video, or audio and returns a confidence score with detection methodology. Your CMS or workflow tool calls the API before publication; flagged content is routed to human review.

Provenance verification API — for incoming C2PA-signed content. When a wire service sends an image with Content Credentials, your workflow should verify those credentials before trusting them. A verification API confirms the signature is valid, unmodified, and from a trusted signer. One option here is the Verigin API, which handles both C2PA credential verification and detection in a single integration, reducing the number of separate vendor relationships your engineering team needs to manage.

The Audit Test

Before August 2, run this test: pull a random sample of 20 pieces of AI-generated content published in the last 30 days. For each, verify you can produce — within 60 seconds — the detection method used, the confidence score, the reviewer who cleared it, the timestamp of their review, and evidence that the label appeared to users at the point of distribution.

If you can do that for all 20, you pass an audit. If you cannot produce any of that information for most of them, your compliance effort has not yet reached the layer that matters to regulators.

The regulation's language is "appropriate technical and organizational measures." Appropriate means documented, systematic, and demonstrably applied. The audit test is how you know if you are there.

There is still time. The organizations that move now will have a working, documented system with operational history before the deadline. The ones that wait for Q3 will be deploying against the clock, with no margin for the integration failures, staff training gaps, and edge cases that every new system discovers in production.
